Welcome to Dhakker. These Terms of Service ("Terms") govern your use of the Dhakker platform and services provided by Dhakker ("we", "our", or "us"). By accessing or using our services, you agree to be bound by these Terms.

1. Description of Service

Dhakker is a digital signage platform designed for mosques. Our service allows mosque administrators to manage and display content including prayer times, announcements, donation campaigns, and Islamic content on digital screens.

2. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 18 years old or have the consent of a parent or legal guardian to use our service.
• One mosque may have multiple user accounts with different roles (viewer, editor, admin).

3. Acceptable Use

You agree to use Dhakker only for lawful purposes. You may not:

• Upload content that is illegal, harmful, threatening, abusive, or otherwise objectionable.
• Attempt to gain unauthorized access to other accounts or systems.
• Use the service to distribute malware or engage in phishing.
• Resell or redistribute the service without our written consent.
• Use automated scripts to access the service without our permission.

4. Content Ownership

4.1 Your Content

You retain all ownership rights to content you create and upload to Dhakker (designs, images, text, and configuration). We do not claim ownership of your content.

4.2 License to Us

By uploading content, you grant us a limited, non-exclusive license to store, process, and display your content solely for the purpose of providing the service to you.

4.3 Our Content

The Dhakker platform, including its design, code, and branding, is owned by us and protected by intellectual property laws. You may not copy, modify, or distribute our platform.

5. Subscription and Payments

• Dhakker offers a 30-day free trial. No credit card is required to start.
• After the trial, continued use requires an active subscription.
• Subscription fees are billed monthly or annually, depending on the plan selected.
• Payments are processed securely through Stripe and/or PayPal.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
• We do not offer refunds for partial billing periods, unless required by applicable law.

6. Free Trial

New users receive a 30-day free trial with full access to all features. At the end of the trial, you must subscribe to continue using the service. We will notify you before your trial expires.

7. Service Availability

We strive to maintain 99.9% uptime, but we do not guarantee uninterrupted service. We may temporarily suspend the service for maintenance, updates, or security reasons. We will provide advance notice when possible.

8. Data and Privacy

Your use of Dhakker is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using our service, you consent to our data practices as described in the Privacy Policy.

9. AI-Generated Content

Dhakker offers AI-powered features including translation and Islamic content generation (hadiths, duas, Quranic verses). While we strive for accuracy:

• AI-generated content is provided as a convenience and may contain errors.
• You are responsible for reviewing and approving all AI-generated content before it is displayed.
• We are not liable for inaccuracies in AI-generated translations or religious content.

10. Donation Campaigns

If you use our donation campaign features (Stripe or PayPal integrations):

• You are responsible for ensuring your donation campaigns comply with applicable laws and regulations.
• Dhakker facilitates the display of donation QR codes and links but does not process donations directly.
• You must have appropriate authorization from your mosque to collect donations.
• Stripe and PayPal have their own terms of service that also apply.

11. Termination

• You may terminate your account at any time by contacting us.
• We may suspend or terminate your account if you violate these Terms.
• Upon termination, your data will be retained for 30 days to allow for export, then permanently deleted.

12. Limitation of Liability

To the maximum extent permitted by law, Dhakker shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the service.

Our total liability for any claims arising from these Terms shall not exceed the amount you paid for the service in the 12 months preceding the claim.

13. Changes to Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top. Continued use of the service after changes constitutes acceptance of the new Terms. We will notify you of significant changes via email or through the platform.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of Germany and the European Union. Any disputes arising from these Terms shall be resolved in the courts of Hamburg, Germany.
